You have to state in the auction that it is faulty or broken.
The winner can get their swapits back by contacting swapitshop and you will get a minus rating (or banned, depending on how bad and how many times it was)

you stated it was new and unused, so that tells me you are selling a new working one, i really hope SwapitShop take a firm approach with you and you get a minus for selling something you knew didnt work.
